Title Deeds in Cyprus: What Every Buyer Must Know

What Is a Title Deed?

A title deed — known in Greek as Πιστοποιητικό Εγγραφής — is the official legal document that proves ownership of a property in Cyprus. It is issued by the Department of Lands and Surveys and registered in the national land registry.

Without a title deed, you do not have full legal ownership. You may have a contract of sale deposited at the Land Registry (which offers some protection), but the title deed is the definitive proof that the property belongs to you.

Why Are Some Title Deeds Missing?

It is surprisingly common in Cyprus for properties to be sold without a separate title deed. There are several reasons:

Developer Still Owes the Bank

The developer may have used the land as collateral for a construction loan. Until the loan is fully repaid, the bank holds a charge on the property, preventing individual title deeds from being issued to buyers.

Subdivision Not Completed

For apartment buildings and housing developments, the developer must apply for subdivision of the master title deed into individual units. This requires planning approvals and can take years if the developer has not completed all obligations (roads, sewage, etc.).

Government Processing Backlog

The Department of Lands and Surveys has historically faced significant processing backlogs. Even when a developer has done everything correctly, issuance can be delayed by bureaucratic bottlenecks.

Risks of Buying Without a Title Deed

  • Cannot easily sell: Selling a property without a title deed is difficult and significantly reduces the pool of buyers willing to purchase.
  • Cannot mortgage: Banks will not accept a property without a title deed as collateral for a loan.
  • Developer creditor risk: If the developer goes bankrupt or has debts, their creditors could potentially make a claim against properties that still fall under the developer's master title.

How to Check Title Deed Status

2Department of Lands and Surveys: You (or your lawyer) can request a search at the local District Lands Office. This reveals the registered owner, any encumbrances (mortgages, memos), and whether an individual title deed exists.

Recent Improvements (2023 Onwards)

The Cyprus government has made significant progress in clearing the title deed backlog since 2023:

  • New legislation fast-tracking the issuance of title deeds, even where developers have outstanding obligations.
  • Buyers can now obtain title deeds independently of the developer in many cases.
  • Tens of thousands of previously stuck title deeds have been issued since the reforms.
